Terms and Conditions - School Gym use

These Terms and Conditions (“Agreement”) governs the use of the School Weights Gym (“School Gym”) run by Healthy Teens, in accordance with Australian laws. By using the School Gym, you agree to comply with the terms outlined in this Agreement.

Eligibility:

a. Only students, faculty, and staff members of the School are eligible to use the School Gym.

b. Students under 18 years old must have permission from a parent or guardian. This must be done via out pre-screening questionnaire .

School Gym Use:

a. Students must registered members of the Healthy Teens program.

b. The School Gym is to be used for weight training and fitness activities only.

c. Students must follow all posted rules, guidelines, and instructions provided by the School or healthy teens staff.

d. The School Gym may have specific operating hours and may be closed during holidays, vacations, or other scheduled periods. Students must adhere to the designated operating hours.

Use of Photos and Videos

As a part of our Healthy Teens program, there may be instances where your child could be photographed and/or videotaped to showcase the activities and initiatives we undertake. They could be used in promotional materials such as brochures, our website, or the school’s website. Kindly let us know in our pre-screening forms if you’d like to opt out.

Health and Safety:

a. Students must be in good physical health and free from any medical conditions that may be aggravated by exercise.

b. It is strongly recommended that Students consult with their regular doctor or physician before starting any exercise program.

c. Students must watch our school gym training introduction prior to beginning.

d. Students must complete the gym induction with one of the Healthy Teens staff before commencing.

e. Students are responsible for using the equipment and gym safely, following proper techniques, and using appropriate weights.

f. Students must notify gym staff immediately of any accidents, injuries, or equipment malfunctions.

g. Healthy Teens requires students to undergo a health assessment or provide a medical clearance before using the School Gym.

h. Students must complete and submit the mandatory pre screening forms provided by the Healthy Teens, which may include information about their health, medical history, and any potential risks or limitations.

School Gym Rules:

a. Students must maintain cleanliness and hygiene in the School Gym. Wipe down equipment after use and return weights and other equipment to their designated places.

b. Students must wear appropriate gym attire, including athletic shoes, while using the School Gym. Clothing that is revealing, offensive, or potentially dangerous is not permitted.

c. Personal belongings should be stored in designated lockers. Healthy Teens is not responsible for lost or stolen items.

d. Food, drinks (except for water in sealed containers), and chewing gum are not allowed in the School Gym.

e. Students must adhere to any time limits or restrictions on equipment usage as determined by the School or gym staff.

f. Students must respect the rights and space of others and refrain from engaging in disruptive or inappropriate behaviour. Harassment, bullying, or any form of physical or verbal abuse will not be tolerated.

Liability and Indemnification:

a. Parents and Students acknowledge and assume all risks associated with the use of the School Gym and its equipment.

b. Healthy Teens and its representatives shall not be liable for any injuries, accidents, or damages that occur while using the School Gym, except in cases of negligence, breach of Australian consumer guarantees, or violation of applicable laws.

c. Parents and students agree to indemnify and hold the School harmless from any claims, actions, or liabilities arising from their use of the School Gym, including but not limited to personal injuries, property damage, or violations of this Agreement.

Suspension or Termination of Access:

a. Healthy Teens reserves the right to suspend or terminate access to the School Gym for students who violate this Agreement, engage in unsafe behaviour, or fail to follow the rules and instructions provided.

b. Any violations of the law, including theft, vandalism, or harassment, may result in immediate termination of access and appropriate legal action.

c. The School may also temporarily close the School Gym for maintenance, repairs, or special events.

Amendments:

Healthy Teens reserves the right to amend or modify these Terms and Conditions at any time, in accordance with Australian laws. Any amendments or modifications will be communicated to the users through appropriate channels, which may include but are not limited to email notifications, posting the revised terms on the Healthy Teens website, or displaying notices within the school gym. Parents and Students are responsible for regularly reviewing the Terms and Conditions to stay informed about any changes. Continued use of the school gym after the amendments have been made constitutes acceptance of the revised terms. If a user disagrees with the modified terms, they should cease using the school gym and notify the Healthy Teens of their decision.

Severability:

If any provision of this Agreement is found to be invalid, unenforceable, or contrary to Australian laws, it shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the provision. If modification is not possible, the invalid or unenforceable provision shall be deemed severable from this Agreement, and the remaining provisions shall remain in full force and effect. In such cases, the parties shall work together in good faith to replace the invalid or unenforceable provision with a valid and enforceable provision that reflects the original intent of the Agreement.

 

Privacy and Security:

a. Healthy Teens acknowledges the importance of privacy and will collect and process personal information provided by users solely for the purpose of managing access to the school gym and ensuring the safety and security of its users. Personal information may include, but is not limited to, names, contact details, identification numbers, and health-related information provided through pre-screening forms.

b. Students personal information will be handled in accordance with applicable privacy laws in Australia, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Healthy Teens will take reasonable measures to ensure the confidentiality, integrity, and security of personal information collected, stored, and transmitted. Access to personal information will be restricted to authorized personnel who require it for the purposes stated in this Agreement.

c. Healthy Teens may share information with trusted third parties, such as service providers, contractors, or health professionals, strictly on a need-to-know basis and for the sole purpose of managing access to the school gym and providing necessary support services. Healthy Teens will ensure that such third parties are bound by appropriate confidentiality and data protection obligations.

d. Students have the right to access, update, and request the removal of their personal information held by Healthy Teens, subject to applicable laws. Students may contact the Healthy Teens to exercise these rights or to seek clarification regarding the handling of their personal information.

e. By using the Facility, parents and students consent to the collection, processing, and storage of their personal information as outlined in this Agreement. Parents and students further acknowledge that Healthy Teens may be required to disclose personal information in response to a lawful request or as otherwise required by applicable laws or regulations.

Acknowledgment of Terms and Conditions:

By using the School weights gym, Parents and students acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions. You acknowledge that it is your responsibility to comply with the rules, guidelines, and instructions provided by Healthy Teens and the gym staff. If you do not agree with any provision of these Terms and Conditions, or if you are unable to comply with any of the requirements outlined herein, you should refrain from using the school gym. Your continued use of the school gym signifies your acceptance of the terms and conditions stated in this Agreement.
